First, we offer our editorial solution to the current agonizingly deplorable situation of vacuous leadership and hard-working folks who can't quit to take other jobs, and can't get paid for the jobs they have.

Ending Shutdowns: A real government must follow the basis of its authority

The supreme authority in this country is not the president. Neither is it the congress. Nor is it anyone in the congress, nor any other person who holds any office, elective or appointive. The supreme authority for governance in the United States is the U.S. Constitution -- except when the Supreme Court messes with it, as they did in their uniquely singular "not-a-precedent-that-can-be-cited" ruling that awarded the 2000 election to Dubya and his cabal.
Such 5-4 derailments in the ditch aside, the rule of law derives from the Constitution, and it requires references and citations that go directly to specific points in the articles or amendments to that Constitution.
Subsequently, any time Constitutional authority cannot be cited, it is an aberration that is clearly outside the way "we, the people," do things in our republic / representative form of democracy. (And that's where the Constitutional role of the Supreme Court is supposed to come-in.)
Now, when it comes to understanding a damn thing about the Constitution, most people prove to be painfully inept even at identifying the Bill of Rights as the first ten amendments to the Constitution. And any amendments beyond those are just terra incognita for the average social-media-addicted, ear-bud-wearing, self-absorbed boob.
Reading the Constitution would provide a revealing experience to most Americans. Like the fact that the first thing it does, after its Preamble, is establish Congress in its Article One. It goes on, in Section Seven of that Article, to require that all revenue legislation originate in the House of Representatives, and in that same Section Seven, it gives authority to Congress to pass anything into law over a presidential veto. In Section Nine of that same first Article, we get the "Emoluments clause" that fuels entirely too many hours of talking heads on cable news, and we also get this, as a required responsibility attendant to Congress' power-of-the-purse:
"No money shall be drawn from the treasury, but in consequence of appropriations made by law; and a regular statement and account of receipts and expenditures of all public money shall be published from time to time."
Which tells us that neither a President, nor any any other individual, can decide to divert money from its approved purpose and use it for something entirely different. Like, taking money from disaster relief funds and using it to build a wall. (It also tells us that all these secret "black budgets" that fund secret wars with unknown sums of publicly unaccountable public monies are unconstitutional, but that's another conversation.)
It -- the Constitution -- doesn't get around to establishing the office of, and limiting the power of, the President, until Article Two.
The Constitution is flagrantly violated when Congress refuses to pass a comprehensive budget for funding and running the federal government, and instead passes an endless series of stop-gap "continuing resolutions" -- CR's -- to keep things going like a kid getting an allowance. In fact, the ONLY reason a government shutdown EVER happens is when "politics" delays passage of a "CR" to fund the government for an eyeblink -- until it's time for the next "CR." So there really is plenty of blame to go around for the current debacle and the excruciatingly unjustifiable pain being inflicted on hard working individuals and families because people are being forced to work without pay.
But the solution does not lie with the talking heads or the lying politicians. It resides in forcing our government to follow the basis of both its authority and its responsibility -- the United States Constitution.
So we should unplug all the chargers and the Twitter feed and the painfully uninformed bloviators of breathlessly newsless social media long enough to do just one thing: we should all be focusing on the authority our government legitimately receives from "we, the people," with particular focus on the 13th Amendment.
Let's tackle the dismissive "Never-heard-of-it" and the insincere "What's-that" and the not-listening-past-the-ear-buds "Huh" crowd all at once.
It was one of the three "Civil War Amendments." The 13th Amendment abolished slavery everywhere it existed. And the 13th Amendment forbade the imposition of "involuntary servitude" except for being able to force labor from convicted criminals:
"Section 1. Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction."
The 13th Amendment turns out to be central -- right now, today -- to whether we have a government that adheres to its Constitutional authority and to anyone's Constitutional Rights.
Because at this moment, and for the past month, over 400,000 federal government employees are being forced to work without pay. Moreover, those individuals can be criminally prosecuted if they don't show-up to do their unpaid work.
Sounds a whole lot like "involuntary servitude," doesn't it?
Therefore, we really, really want to see the unions file an emergency petition for a hearing before the Supreme Court on a 13th Amendment violation being perpetrated by the Trumpertantrum-in-Chief.
In the meantime, we want to see Congress pass legislation to reopen the government and fund its operation -- and to pass that into law over a presidential veto, if necessary, as the Constitution provides. (Are you listening, Mitch McConnell? Do your damn job and bring to the Senate floor, for a vote, ALL bills passed by the House of Representatives.)
Then, we want to see a lesson learned and applied from the idiocy of this, and the previous, shutdowns: the entire Congress must stop screwing-around with its extraconstitutional paradigm, serial angst, and creation of opportunities for intransigent Trumpertantrums, that are ALL a product of these wheeled-and-dealed "CR's." Congress must rediscover ITS Constitutional obligations to all of us (including government employees held in involuntary servitude) and legislate REAL budgets that make these stupid shutdowns impossible.
Unrealistic in a culture dependent on gridlock? We can discover toot sweet if we have a legitimate government any more.

* What is Hawaiian Slack Key Guitar Music?
Hawaiian Slack Key Guitar (ki ho'alu) is truly one of the world’s great acoustic guitar traditions, considered to be one of the oldest music traditions to still be a viable (other than just historical) part of a modern culture. Ki ho'alu, which literally means to "loosen the key," is the Hawaiian language name for the solo finger-picked style unique to Hawaii. In this tradition, the strings (or "keys") are "slacked" to produce many different tunings, which usually contain a major chord, or a chord with a major 7th note, or sometimes one with a 6th note in it. Each tuning produces a lingering sound behind the melody and has a characteristic resonance and fingering, with the thumb playing the bass while the other fingers play the melody and improvise in a finger-picked style.
* This year’s Southern California Slack Key Festival’s line-up includes George Kuo , Kawika Kahiapo, Sonny Lim, Jeff Peterson, Jim “Kimo” West, Teresa Bright, Bobby Ingano, and Kunia Galdeira.
* James "Kimo" West is a L.A.-based composer, guitarist and music producer. He is also well-known as long-time guitarist for the world's most successful musical satirist, "Weird Al" Yankovic and also as one of the world's top "slack key" guitarists. For over twenty-five years, he has composed music for features, network and cable TV, advertising, documentaries and web series. Completely self-taught, he learned orchestration "on the job" by re-scoring music for thirteen classic Fox films, entirely by ear. Scores for such films as "Journey to The Center of the Earth", "The Diary of Anne Frank" and "The Sun Also Rises" were being released in foreign markets with new language tracks and, since many of the music elements were missing, Jim was hired to "re-score" the original music under dialog. His interest in "ki ho'alu" or Hawaiian slack key guitar began during his first visit to Hawaii, in the rural town of Hana, Maui. It was there he fell in love with the lilting sound of slack key. Evidently director Alexander Payne did as well, featuring slack key music for the score of the Oscar-winning film, "The Descendants". "Kimo" as he is known in Hawaii is recognized as one of the masters of slack key and has received many awards such as The Hawaii Music Award, The L.A. Treasures Award and is twice-nominated for the Na Hoku Hanohano Award (the Hawaiian "Grammy". He performs in slack key festivals and concerts and his slack key compositions grace five CD's, documentaries and national TV spots. His work with "Weird Al" has produced three Grammy's, many gold and platinum albums, international touring and TV appearances on The Tonight Show, The View, Late Night with Jimmy Fallon, Late Show with Craig Ferguson and countless others.* Kala Koa Entertainment celebrates 12 years of bringing the biggest and brightest names in Hawaiian music to "the mainland" with the 2019 Southern California Slack Key Festival.

* At age 76, Michael Nesmith is on a roll. The singer-guitarist has finally embraced his past as a member of The Monkees in tours with Micky Dolenz the past few years. He's also drawn from his underrated solo career, where he paved the way for numerous others by mixing rock and country long before it was hip. Tonight, Papa Nes revisits his 1972 solo album, "And the Hits Just Keep on Comin’," accompanied by guitarist Pete Finney, who evokes parts originally played by late pedal-steel maestro Red Rhodes. "And the Hits..." is an unusual record with thoughtful ballads like "The Upside of Goodbye" and a homespun intimate version of the early Linda Ronstadt hit "Different Drum" delivered with little more than stripped-down guitars. * Brittni Paiva (pie –VAH) already a multi award-winning instrumentalist is known for her stunning articulation of what she can do on the ukulele going from slow and moving, to rapid-fire, classical-ballet, to ancient Japan, translating forms of jazz, world beat, pop, Flamenco and Latin, and filter these styles through her 4-string ukulele.
* Brittni and her ukulele are a brilliant match: Both are humble in nature, small in size, and very powerful with proper delivery. Brittni and the ukulele in general have gained notoriety, no longer confined by stereotypes about the instrument. * Releasing her 5th CD with the legendary Grammy winner Tom Scott — who personally requested to play with her at a concert — thinks Paiva is the real deal, because of her ability to play all kinds of music without losing her identity. “She plays it like a guitar, giving her a wide range of possibilities. She adopts tunes to this instrument, and makes them sound full and rich. She’s doing a great job and has a great future…She’s got a really unique voice in music,” he raved.

That is an example that Falling James cites, characterizing it as, "she pleads soulfully on 'Fangirl.'" He quotes more of her lyrics: "'I’m all dressed up, queen with no crown / I try to be tough / It’s safer here on the ground,' she laments on the more introspective ballad 'Girls Like Me'."
* He also adds, "Catch her now in small clubs while she’s still a cult heroine."
* That may be true, James. It's more a case of whether she's someone's cup of whatever they're drinking.
